Subsequently, NSLEP 1989 has been repealed, with the exception of the deferred area - 79-81 Berry St North Sydney, and the whole of the Council area is subject to NSLEP 2001. NSLEP 2001 provides the basic planning objectives and development controls for new buildings and other developments, and states whether development consent is required for particular kinds of development. The objectives and controls cover zoning, height, floor space ratios, landscaping, overshadowing, and heritage and conservation areas. Development not specifically permitted by the NSLEP 2001 is prohibited, meaning that no development application can be made for that kind of development. NSLEP 2001 is supplemented by North Sydney Development Control Plan 2002, which provides guidelines on detailed aspects of development.
