North Sydney Development Control Plan 2002

The North Sydney DCP 2002 (DCP) is Council's guidelines which contain detailed provisions on all aspects of development. Unlike the North Sydney Local Environmental Plans (LEP), these provisions are not legally binding, however they are given weight in the assessment of development applications.

North Sydney Council undertook a major review of its development control plans. All these plans are now contained in a single document known as North Sydney Development Control Plan 2002 (North Sydney DCP 2002). Council at its meeting on 18 February 2002 adopted North Sydney DCP 2002 which supersedes all other development control plans previously adopted by Council.

North Sydney DCP 2002, effective from Thursday 21 February 2002, applies to all land in the North Sydney Local Government Area where NS LEP 2001 applies and contains policy relevant to development on land where NS LEP 1989 applies.

North Sydney DCP 2002 identifies all North Sydney's planning controls in two ways. Firstly, it focuses on general issues such as residential development and cultural resources. Secondly, it is based on localised planning issues derived from the Area Character Study.

North Sydney DCP 2002 - Amendments

14-16 Military Road, Neutral Bay

At its meeting on 29 November 2010, North Sydney Council adopted amendments to Section 7.6 - Waters Neighbourhood contained within Part B Character Area Statements of North Sydney Development Control Plan (NSDCP) 2002.

The draft Amendments to NSDCP 2002 incorporate specific controls for 14-16 Military Road, Neutral Bay.

The updated DCP Section is now included in NSDCP 2002 and comes into effect on 9 December 2010.


Car Parking

At its meeting on 20 October 2008, North Sydney Council adopted amendments to Section 9 - Car Parking of North Sydney Development Control Plan (NSDCP) 2002.

The draft Amendments to NSDCP 2002 incorporate changes to the on-site car parking rates for the commercial and retail component of Mixed Use development. The draft amendments also responds to a Council resolution to reformat the Section to make it easier to use and understand.

The updated DCP Section is now included in NSDCP 2002 and comes into effect on 30 October 2008.


Outdoor Dining & Display of Goods on Footpaths

At its meeting on 12 May 2008, North Sydney Council adopted North Sydney Outdoor Dining & Goods Display Policy in conjunction with amendments to Section 21 of the North Sydney Development Control Plan 2002 (NSDCP 2002.

The Outdoor Dining & Goods Display Policy replaces Council's existing "Use of the Footpath for Outdoor Dining or Displaying of Goods Policy". The new Policy has been updated and incorporates new provisions to respond to amenity issues and to improve clarity as to which process is required to obtain a permit to allow a person to undertake outdoor dining and displaying of goods on footpaths.

The amendments to NSDCP 2002 reflect the changes to the Outdoor Dining & Goods Display Policy to ensure that the objectives and provisions of the two documents are consistent. The amendments also involve some minor reformatting of the Section to make it easier to use and understand.

The updated DCP Section is now included in the NSDCP 2002 and comes into effect on 29 May 2008.


Public Art Adoption

At its meeting on 30 July 2007 Council adopted draft amendments to the North Sydney Development Control Plan 2002 (DCP 2002) and a draft Arts Plan Guide.

The amendments to the NSDCP 2002, and Arts Plan Guide provides more clarity in the operation of the DCP itself in relation to the provision of public art in mixed use and commercial development.

Character Statement

At its meeting on 11 September 2006 Council adopted amendments to the North Sydney Development Control Plan 2002 (NSDCP 2002). The proposed amendments relate to the current review of the North Sydney Centre planning controls, specifically addressing the North Sydney Centre Character Statement and reflect recent changes in legislation covering DCPs.

The proposed amendments incorporate significant height controls and additional setbacks for properties in the North Sydney Centre.

The updated sections are now included above in the NSDCP 2002 and came into effect on 21 September 2006. To see the changes, please refer to this tracking document:

Childcare Centres, Rooftop Signage, Splay Corners

These general amendments incorporate a number of issues that relate to childcare centres, rooftop signage, and splay corners. The updated sections will now be included in the NSDCP 2002 and come into effect on 1 June 2006.

Staff in Council's Community and Library Services Department have identified several changes to State Government guidelines and Australian Standards which necessitate the amended/update of NSDCP2002. The amendments are contained in the document attached below. Only those pages of NSDCP 2002 where changes are proposed are included. The proposed inclusions are underlined and the proposed deletions are indicated by a strikethrough.

The current North Sydney Development Control Plan 2002 recognises that roof or sky advertisements are a unique feature of North Sydney's skyline, but does not encourage further proliferation of them in mixed use areas.

The main issue associated with roof signs is the light spill generated from them. The use of flood lighting and neon in the past has created amenity issues around these sites.

The amendments prohibit new signs in all mixed use areas and ensures that when existing signs are replaced, steps are taken to minimise problems associated with illumination.

Splay corners on buildings at ground level are common in North Sydney's commercial and mixed use areas despite the limited reference to them within NSDCP 2002. An opportunity exists for council to provide more guidance in the creation of splay corners. The adopted amendments of DCP 2002 for Splay Corners aim to strengthen controls to provide more consistency and guidance to the size of splay corners.

North Sydney DCP Version 1 (1991)

NS DCP Version 1 came into force on 10 January 1991 and provides requirements and guidelines on all aspects of development including car parking, energy efficiency, landscaping and building design. NS DCP Version 1 supplements NS LEP 1989 and is only relevant in areas where NS LEP 1989 applies.

In addition, NS DCP 2002 contains policy relevant to development on land where NS LEP 1989 applies.
