North Sydney Local Environment Plan 2001

A comprehensive review of the North Sydney Local Environmental Plan (NSLEP) began in August 1997. The review addressed important issues raised by Councillors and community members and reflects the consultation that was undertaken with the community in 1997 and 1998. The LEP 2001 was adopted by Council and placed on exhibition from 9 September to 20 October 1999.

On 6 March 1999, Council considered submissions, adopted changes and resolved to re-exhibit the revised DLEP 2001 from 13 March to 10 April 2000. On 15 May 2000, Council considered submissions, adopted changes and resolved to re-exhibit for a final time, on the basis of legal advice, from 18 May to 15 June 2000.

Council resolved to adopt the DLEP 2001 in its current form on 10 July 2000 and on June 1 2001 it was approved by the then NSW Minister for Urban Affairs and Planning, Andrew Refshauge.

Important Note

State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP) was gazetted on the 12 December 2008 and commenced operation on the 27 February 2009.

The Codes SEPP applies state-wide and specifies exempt development under that Policy. Consequently, from 27 February 2009 the exempt development provisions of North Sydney Local Environmental Plan 2001 (NSLEP 2001) will no longer apply, but only in so far as they relate to the same development types covered by the Codes SEPP. Exempt development types listed under Schedule 6 of NSLEP 2001 and that are not covered by the Codes SEPP, will still be able to be undertaken as exempt development pursuant to the provisions of NSLEP 2001.

Furthermore, where the same complying development types exist under both the Codes SEPP and NSLEP 2001, an applicant may choose to apply either the provisions from the Codes SEPP or the provisions from NSLEP 2001, but not both, when seeking approval for a complying development certificate. However, this option ceases to take effect on 27 February 2010, where by the provisions of the Codes SEPP will prevail and those of NSLEP 2001 will no longer apply.
