Late Night Trading Hours

At its meeting on 16 March 2015 Council adopted amendments to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, a new chapter, Part B Section 7 - Late Night Trading Hours, has been incorporated within NSDCP 2013. It addresses issues specific and unique to North Sydney regarding late night trading, and sets trading hours that allow for the contemporary requirements of late night trading across North Sydney while acknowledging the proximity of residential development to many late night trading sites. The amendment to NSDCP 2013 comes into effect on 26 March 2015.

Background

In response to the need to revisit and resolve issues pertaining to late night trading and address the Direction 3.1.1.1 in Council’s Delivery Program, Council Officers commenced the ‘Late Night Trading, Extended Hours and Small Bars Review’ (the Review) in July 2013.

The overarching aim of the review is to develop appropriate planning controls relating to Late Night Trading, in the form of a draft amendment to North Sydney Development Control Plan 2013 (NSDCP 2013) and the insertion of a new chapter, Part B Section 7 - Late Night Trading Hours into this DCP. The intention of this chapter is to address issues specific and unique to North Sydney regarding late night trading, and set trading hours that allow for the contemporary requirements of late night trading across North Sydney while acknowledging the proximity of residential development to many late night trading sites.

 

Preliminary Consultation

Council undertook preliminary consultation throughout November 2013 - January 2014 through the distribution of a brochure and questionnaire to over 18,000 residents, businesses and property owners within and surrounding those areas where late night trading is permitted. The consultation was aimed at ascertaining views on late night trading across various suburbs within the North Sydney Local Government Area. Council received over 800 submissions in response to this preliminary consultation.

On 3 March 2014, Council Officers prepared a report to the Legal and Planning Committee to present the findings of the preliminary consultation wherein the Committee resolved to continue to pursue the development of appropriate planning controls relating to Late Night Trading.

 

Draft Amendment to North Sydney Development Control Plan 2013

A draft Development Control Plan (DCP) Amendment Late Night Trading was formulated having regard to the results of the preliminary consultation, research and analysis of Council’s current late night trading practice, and consultation with various stakeholders. The draft DCP was reported to Council at its meeting on 23 June 2014, wherein Council resolved to adopt the draft amendment and place the draft DCP on public exhibition for a minimum of 28 days with a report be provided to Council after the conclusion of the exhibition period.

The draft DCP amendment was placed on public exhibition between 24 July 2014 and 21 August 2014 where are number of submissions were received raising various issues.

 

Exhibition of Revised Draft Amendment to North Sydney Development Control Plan 2013

In response to submissions received following the public exhibition of a draft Development Control Plan (DCP) Amendment Late Night Trading, a report addressing these submissions was prepared, and a revised draft DCP amendment developed proposing the following changes:

  • Modifications to the trading hours in McMahons Point;
  • Clarification on the application of the controls in relation to the operation of existing premises; and
  • Other minor amendments.

At its meeting on 17 November 2014, North Sydney Council resolved to place this revised draft DCP amendment on public exhibition.
