North Sydney Development Control Plan 2013 (NSDCP 2013)

NSDCP 2013 supports the implementation of the provisions to North Sydney Local Environmental Plan 2013 (NSLEP 2013). It contains detailed provisions on all aspects of development not covered under NSLEP 2013. The DCP provisions are not legally binding, however they are given weight in the assessment of all development applications.

NSDCP 2013 was adopted by Council at its meeting on 2 September 2013 and it came into force on 13 September 2013. It supersedes all other development control plans previously adopted by Council. The DCP applies to all subject to NSLEP 2013, which generally applies to all land in the North Sydney Local Government Area.

NSDCP 2013 identifies all of North Sydney's planning controls in two ways. Firstly, it focuses on general issues such as residential development and cultural resources. Secondly, it is based on localised planning issues derived from the Area Character Study.

Amendments

 

Hume Street Park

At its meeting meeting on 19 September 2016 Council adopted an amendment to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, the amendments to NSDCP 2013 seek to allow the development of Hume Street Park in accordance with the Concept Design endorsed by Council on 21 September 2015. The amendments affect Section 3 of Part B of NSDCP 2013. The amendments to NSDCP 2013 comes into effect on 7 July 2016.

Education Precinct and St Leonards/Crows Nest Precincts 2 & 3

At its meeting meeting on 14 June 2016 Council adopted an amendment to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, the amendments to NSDCP 2013 reflect the recommended principles of the Education Precinct Planning Study (2013) and St Leonards/Crows Nest Planning Study Precincts 2&3. The amendments affect Parts B, C and D of NSDCP 2013. The amendments to NSDCP 2013 came into effect on 7 July 2016.

Car Parking Rates for Residential Flat Buildings in B4 Zone

At its meeting on 20 July 2015 Council adopted an amendment to North Sydney Development Control Plan 2013 (NSDCP 2013).  In particular, the amendment to NSDCP 2013 introduces maximum parking rates for ‘residential flat buildings’ within the B4 Mixed Use zone.

The amended section of NSDCP 2013 came into effect on the 6 August 2015.

Late Night Trading Hours

At its meeting on 16 March 2015 Council adopted amendments to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, a new chapter, Part B Section 7 - Late Night Trading Hours, has been incorporated within NSDCP 2013. It addresses issues specific and unique to North Sydney regarding late night trading, and sets trading hours that allow for the contemporary requirements of late night trading across North Sydney while acknowledging the proximity of residential development to many late night trading sites. The amendment to NSDCP 2013 comes into effect on 26 March 2015.

Grosvenor Lane Car Park

At its meeting on 15 December 2014 Council adopted amendments to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, Section 5.1.6 – Grosvenor Lane Car Park (located above) has been amended to include provisions to guide any future redevelopment of the subject site and adjoining land. The amendment to NSDCP 2013 comes into effect on 8 January 2015.

North Sydney Bus Depot

At its meeting on 15 December 2014 Council adopted amendments to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, Section 5.1.4 – North Sydney Bus Depot (Section 3 Part 5 above) has been amended to include provisions to guide any future redevelopment of the subject site and adjoining land. The amendment to NSDCP 2013 comes into effect on 8 January 2015.

St Leonards/Crows Nest Planning Study - Precinct 1

At its meeting on 3 February 2014 Council adopted an amendment to North Sydney Development Control Plan 2013 (NSDCP 2013). In particular, Section 2.4.3 - Setbacks contained within Part B (Commercial and Mixed Use Development) and Section 3.1.3 - Desired Built Form contained within Part C (Area Character Statements - St Leonards/Crows Nest Planning Area) were amended to include provisions for increased setbacks and site-specific podium heights at locations identified by the St Leonards/Crows Nest Planning Study - Precinct 1. The amendment to NSDCP 2013 comes into effect on 20 February 2014.

Draft Amendments

Exhibition of Draft Amendment to North Sydney Development Control Plan 2013 – Advertising and Signage

At its meeting on 21 November 2016, Council resolved to place a draft amendment to North Sydney Development Control Plan 2013 (NSDCP 2013) regarding advertising and signage on public exhibition.

It is proposed to amend Section 9 – Advertising and Signage to Part B of NSDCP 2013 to:

  • Provide improved guidance when considering applications for digital display signs and roof top signage;
  • Revise the signage character area statements to better reflect the desired future characters of various localities;
  • Correct a number of minor errors; and
  • Reword certain provisions to improve the readability and implementation of Council’s adopted policy positions.

In response to requests from submitters, Council has agreed to extend the public exhibition period of the draft DCP amendment.

The draft DCP amendment is now on public exhibition from Thursday 2 February 2017 to Friday 31 March 2017.

Planning Proposal

1-11 Cowdroy Avenue and 22 Stratford Street, Cammeray

&

Draft Amendment to North Sydney Development Control Plan 2013.

 

At its meeting on 21 September 2015, North Sydney Council considered a report addressing the submission of a Planning Proposal which sought amendment to North Sydney Local Environmental Plan 2013 (NSLEP 2013) as it relates to 11 Cowdroy Avenue, Cammeray. In particular, the Planning Proposal sought to amend NSLEP 2013 to permit a second dwelling in the form of a detached dual occupancy at 11 Cowdroy Avenue, Cammeray. Council resolved not to proceed with this Planning Proposal to Gateway Determination under s.56 of the Environmental Planning and Assessment Act 1979.

On 5 January 2016, the applicant of the Planning Proposal lodged an application for a Pre-Gateway Review with the Department of Planning and Environment (DPE). Following the Pre-Gateway Review process, the Minister for Planning issued a Gateway Determination on 30 November 2016 enabling the Planning Proposal to proceed to public exhibition subject to meeting a number of conditions, contrary to Council’s adopted position.

In particular, the revised Planning Proposal now seeks the following amendments to NSLEP 2013:

  • amend the Land Zoning Map by rezoning 1, 3, 5, 7, 9 and 11 Cowdroy Avenue, Cammeray and 22 Stratford Street, Cammeray from E4 Environmental Living to R2 Low Density Residential; and
  • amend Schedule 1 – Additional Permitted Uses to permit ‘dual occupancies (detached)’ (with development consent) on land at 11 Cowdroy Avenue, Cammeray.

In addition, Council resolved on 24 October 2016 to place an associated draft amendment to North Sydney Development Control Plan 2013 (NSDCP 2013) on public exhibition concurrent with the Planning Proposal that seeks to introduce site specific controls for 11 Cowdroy Avenue, Cammeray.

The Planning Proposal and draft amendments to NSDCP 2013 will be on public exhibition for a period of 28 days from Thursday 23 February 2017 to Wednesday 22 March 2017. The exhibition material comprises the following:

Public Domain Style Manual and Design Codes

The Public Domain Style Manual and Design Codes are guidelines that address streetscape character, functionality and accessibility. The document sets out comprehensive design objectives to achieve a distinctive look among all the different villages in the North Sydney local government area. They are a practical guide covering all aspects of urban street design, streetscape furniture and public domain elements.

From 2014 onwards, one key change will be replacing the existing sandstone pavers in the CBD with hard wearing granite with a serviceable finish. The granite will be a complimentary colour to the sandstone so that the transition will blend into the streetscape. Other significant modifications include new designs for seats and bus shelters in the North Sydney Local Government Area.

Outdoor Dining and Display of Goods on Footpaths

At its meeting on 12 May 2008, North Sydney Council adopted North Sydney Outdoor Dining & Goods Display Policy. The Policy incorporates provisions to respond to amenity issues and to improve clarity as to which process is required to obtain a permit to allow a person to undertake outdoor dining and displaying of goods on footpaths.

At its meeting on 30 July 2007 Council adopted a draft Arts Plan Guide.

The Arts Plan Guide provides more clarity in the operation of the DCP in relation to the provision of public art in mixed use and commercial development.

Waverton Peninsula Strategic Masterplan

The Waverton Peninsula Strategic Masterplan sets out strategies for the future development of the Coal Loader / Caltex and BP ex-industrial sites for public open space and working waterfront land uses. It outlines the design, planning and management processes for the sites in line with the guiding principles established in NSW Government statutory planning controls.

NSDCP 2002 was adopted by Council at its meeting on 18 February 2002 and came into force on 10 January 1991. This DCP supplements NSLEP 2001 and is only relevant in areas where NSLEP 2001 applies. The DCP was repealed in its entirety on the 13 September 2013.

North Sydney DCP Version 1 (1991)

North Sydney DCP Version 1 (648KB)

NS DCP Version 1 came into force on 10 January 1991 and provides requirements and guidelines on all aspects of development including car parking, energy efficiency, landscaping and building design. NS DCP Version 1 supplements NS LEP 1989 and is only relevant in areas where NS LEP 1989 applies.

In addition, NS DCP 2002 contains policy relevant to development on land where NS LEP 1989 applies.
