This permit exists for a business or individual that needs to undertake works on a Council road and/or footpath. Including but not limited to:

  • Excavation
  • Concrete pours
  • Crane works
  • Material deliveries
  • Skip bins
  • Footpath use
  • Road use/closures and
  • Out of hours road and footpath use

This permit gives the applicant permission to stand and operate the nominated item for the date and time specified, only at the location or locations nominated on the permit.

No work is permitted to begin until a valid permit is obtained.

Failure to obtain a permit or non-compliance with the Permit Conditions is a breach of the Local Government Act 1993 as amended and/or the Roads Act 1993 as amended. Infringements will be issued in accordance with the regulations of these acts.

This permit may be cancelled without notice should public or residential amenity be detrimentally affected.

Before you apply

Please read and understand the below information before applying for a Construction Permit to occupy a road and footpath.

A minimum of 5 business days is required for all applications (e.g. apply Thursday to work the following Friday).

  • All relevant fees are to be paid in full prior to the activity taking place. This also applies to change of date applications
  • There will be no refund or credit of fees where an application is unsuccessful
  • Changes to parking meters and any excavation requires a minimum of 10 business days notice
  • Independent applications are required for multiple activities in separate locations or dates

Guidelines

Traffic Guidance Scheme

Council must be informed of what work is being undertaken and where you are working at all times. Your application should correlate with your Traffic Guidance Scheme (TGS).

If your works are moving along a road or footpath over multiple days, several TGS’s should be lodged with your application notifying what dates you will be along different sections of the road or footpath.

The amount of space you are allowed to occupy will depend on the TGS submitted within your application.
 

Road versus footpath permits

If you have a road permit you can use the footpath for free during works as long as it remains open.

If you have a road permit and are closing the footpath, you will be charged footpath occupancy fees.

If you only have a permit to use the footpath, then you cannot use the road at all.

Parking

The number of parking spaces allocated is dependant on how many are requested and approved. 

You can reserve parking the day before however these spaces must be paid for.

Reservation of parking spaces are charged on a ‘per day’ basis as per the fee schedule. Metered parking spaces cost more. Only machinery or work vehicles (such as concrete trucks or delivery trucks) can park in paid spaces.

Personal vehicles or utes are not allowed.
 

Excavating

Restoration fees apply to any applications needing to excavate or dig into any Council infrastructure.

If restoration is completed to Council standards, you may request a refund on restoration costs. This depends on an inspection by Council.

If you need to excavate around parking meters for utility works, please include the parking meter team in any emails to the permits officer at least 2 weeks before work commences. 

Fines may apply for any liable damages caused to parking meters.

Permitted truck sizes

  • Small Rigid Vehicles are 6.4 metres in length
  • Medium Rigid Vehicles are 8.8 metres in length
  • Heavy Rigid Vehicles are 12.5 metres in length

No truck and trailer can be used in the North Sydney LGA.

Anything over 12.5 metres in length requires specific approval with truck routes/swept paths.

Any vehicle over 19 metres in length requires NHVR approval plus route/swept paths.


Road closure applications

Road closures require a completed application including payment of relevant fees with a minimum of 25 business days notice to both Council and Transport for NSW.

Residents must be notified 7 business days prior and again 2 business days prior to works commencing.

Normal construction hours

Normal construction hours are:

  • 7am to 5pm weekdays
  • 8am to 1pm Saturday
  • No works permitted on Sunday

Work can be completed outside normal construction hours for public safety (concrete pours are excluded).

Date changes

If you need to change the date of an approved application a new application is required.

Change of dates require Council to assess any impacts the new date has on other scheduled activities within the area and ensure all relevant stakeholders and residents are notified.

Council must be notified by midday on the day of the approved permit if the works will not proceed.
 

Booking suppliers and contractors

Please confirm suppliers and contractors are available for the date you are applying for before submitting your application.
 

Permit conditions

You are required to comply with your permit conditions or the permit can be revoked at any time by Council officers.

If works continue without a permit, you may be subject to regulatory actions including fines or immediate stop work orders.

Required documents

Before you commence the application form, you will need to have the following documents and supporting material ready to submit to Council:

  • Accurate description of works
  • Start and finish dates
  • Permit numbers of any previous permits for the works
  • Development Application (DA) number if works are associated with a DA
  • Measurements of the affected area(s), including the whole site with Traffic Management included
  • Any affected parking, including parking meters, Touch N Gos (see interactive map)
  • Specifications (measurements, weight etc) of any plant, machinery or vehicles used in the works
  • Draft of community notification letter
  • Public Liability Insurance certificate
  • Traffic Guidance Scheme (if required)
  • Road occupancy licence (if required)
  • Swept paths for any heavy vehicles (if required)
  • Police approval (if required)
  • Schedule of works if requesting Out of Hours works
  • Written correspondence if works affect neighbours, taxis, buses
  • Photos of the site (if required)

Each application requires the indemnity and insurance form to be filled out and signed. A community notification letter is required that explains to the community who you are, what you are doing and when.

Once approval has been obtained from a Council permits officer, the community notification letter needs to be distributed within a 100 metre radius of the site at least 2 business days before works commence.

Fees

All fees must be paid prior to works commencing and within 24 hours of Customer Service emailing the B-point link for payment.

Service Fee

Initial non-refundable application fee.

$200   

To be invoiced by Council at a later date: 

Service Fee
Parking spaces (regardless of kerb side restriction) $350 per metered space, per day
Skip bin (maximum of 2 weeks) $240 per non metered space, per day
Footpath occupancy (retains consistent 1.2 metre footpath width) $10 per m2, per day
Digging/excavation/opening Restoration fees are site-dependent and include parking and footpath occupancy fees
Temporary full road closure $1990 plus parking per day
Out of hours construction $680 for 3 nights per week
Change of date (5 business days notice, 3 if due to weather) $120

 

Submit an application

Begin application form

Once you have submitted your application and paid the $200 application fee, Customer Service will issue you a permit number. This is your reference number, please use this number in the subject of all email correspondence. Any emails without reference to the permit number will not be replied to.

Once the permit number is issued, your application will go to the permits team for review and they will email you all information including the fees owed. All correspondence must be completed via email, not by phone.

If you do not submit a completed application, the permits team will ask you to submit another application and your requested days may not be available.

Please note:

Do not upload the whole CTMP or other unnecessary information eg. engineering plans or TGSs that do not relate to the works you are applying for.

Once the initial email with a completed application is made to Customer Service, please send all email correspondence to permits@northsydney.nsw.gov.au.

At least three days notice is required for any permit extension. Applications made on the day of a permit expiring will not be accepted. Works must be exactly the same as the original permit on extension application.
